1. Acceptance of Terms

By accessing or using the Postmate platform, website (postmate.tech), or mobile applications (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is owned and operated by Postmate.

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity. If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

Postmate provides a cloud-based logistics management software that enables courier agents to coordinate bookings, generate courier labels, handle customer tracking, driver dispatch, and manage billing/reconciliation. The Service includes access to dashboard panels, customer tracking portals, and courier partner APIs.

3. User Accounts & Registration

To use the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your account credentials (passwords, API tokens).
  • Notify us immediately of any unauthorized use of your account.
  • Accept responsibility for all activities that occur under your account.

4. Subscriptions, Fees & Billing

Access to the Service is billed on a subscription basis (monthly or annually) as detailed on our Pricing page.

  • Recurring Billing: Subscriptions automatically renew at the end of each billing cycle unless cancelled.
  • Taxes: All fees are exclusive of GST and other applicable taxes, which will be charged in accordance with Indian tax regulations.
  • Non-Payment: We reserve the right to suspend or terminate access to the Service for accounts with overdue payments.

5. User Conduct & Acceptable Use

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law or regulation.
  • Transmit fraudulent, illegal, or prohibited package data.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Attempt to gain unauthorized access to the Service or its related systems.

6. Third-Party Carrier APIs

Our Service integrates with third-party logistics carriers (e.g. FedEx, DHL, Aramex, etc.) via their public APIs. We are not responsible for the performance, availability, or accuracy of third-party carrier APIs, labels, or tracking services. Your use of third-party carrier services is governed by their respective terms of service.

7. Intellectual Property

The Service, including its design, source code, logos, illustrations, graphics, and features, is the intellectual property of Postmate and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or reverse engineer any part of our Service.

8. Limitation of Liability

To the maximum extent permitted by law, Postmate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat, India.
